    How Lytwork AI Ltd collects and protects your data under UK GDPR, and the terms that govern your use of the LYTWORK platform.

    This notice explains how Lytwork AI Ltd collects, uses, and protects your personal data. We are committed to handling your information with care and in full compliance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

    Lytwork AI Ltd is an AI-powered staffing platform that connects hospitality and events businesses with vetted frontline workers via WhatsApp. We act as the data controller for all personal data we collect and process.

    What data we collect

    If you are a worker

    • Full name, date of birth, home address, email address, and phone number
    • Government-issued photo ID (passport, driving licence, or national ID card)
    • Right to Work documentation (biometric residence permit, share code, or visa)
    • National Insurance number
    • Bank account details (sort code and account number) for payment purposes
    • CV and employment history
    • DBS check results, where applicable
    • WhatsApp communications relating to shift bookings and confirmations
    • Reliability scores and behavioural data derived from your platform activity

    If you are a client contact

    • Full name, job title, and employer details
    • Business email address and phone number
    • WhatsApp communications relating to shift requests and bookings
    • Billing contact information

    If you visit our website

    • Basic analytics data (pages visited, time on site, browser type) — collected via cookies where you have consented

    How we use your data

    We use personal data for the following purposes:

    • Verifying your identity and right to work in the UK
    • Matching workers to shift requests from our clients
    • Processing payments and worker payouts via Stripe Connect
    • Conducting background checks through our partner Certn
    • Communicating shift opportunities, confirmations, and updates via WhatsApp
    • Calculating reliability scores to improve the quality of our matching
    • Meeting our legal obligations as a staffing business (HMRC, employment law, ICO)
    • Managing our client relationships and bookings

    We will not use your personal data for any purpose that is incompatible with the purpose for which it was originally collected.

    Who we share your data with

    We share personal data only with trusted third-party processors who are contractually required to handle it securely and in accordance with UK GDPR. We do not sell your data.

    Lytwork does not transfer personal data outside of the UK or EEA without appropriate safeguards. Where international transfers are necessary (for example, via WhatsApp's global infrastructure), we ensure adequate protections apply.

    Your rights

    Under UK GDPR, you have the following rights in relation to your personal data:

    • Rectification — ask us to correct inaccurate or incomplete data
    • Erasure — ask us to delete your data, subject to any legal retention obligations
    • Restriction — ask us to limit how we process your data in certain circumstances
    • Portability — receive your data in a structured, machine-readable format
    • Object — object to processing based on legitimate interests
    • Automated decisions — request human review of any automated matching or scoring decisions that significantly affect you

    If you are not satisfied with our response, you have the right to complain to the Information Commissioner's Office (ICO) at ico.org.uk or by calling 0303 123 1113.

    Security

    We take the security of your personal data seriously. Our measures include:

    • Access to personal data restricted on a strict need-to-know basis
    • All systems protected by strong credentials and two-factor authentication where available
    • WhatsApp Business API communications are end-to-end encrypted
    • Payment data is processed by Stripe and never stored directly by Lytwork
    • Background check data is processed by Certn under a formal Data Processing Agreement

    In the event of a data breach posing a risk to your rights and freedoms, we will notify the ICO within 72 hours and inform you without undue delay where required.

    Terms of Service

    These terms govern your use of the LYTWORK platform, website and related services (the "Service"). By creating an account, booking a shift, or otherwise using the Service, you agree to be bound by these terms.

    Agreement

    This agreement is between you and Lytwork AI Ltd ("LYTWORK", "we", "us"), a company registered in England and Wales (registered office: 2 Rocastle Road, London, SE4 2BP). If you are using the Service on behalf of a business, you confirm you have authority to bind that business to these terms.

    We may update these terms from time to time. Material changes will be notified by email or via the Service at least 14 days before they take effect.

    The service

    LYTWORK is an AI-powered staffing platform that helps businesses ("Clients") fill shifts with vetted self-employed workers ("Workers") via WhatsApp and AI calling. We introduce Workers to Clients but, unless expressly stated, we are not the employer of Workers and do not supply labour as a master vendor.

    We provide the Service on a reasonable-endeavours basis. We do not guarantee that any particular shift will be filled, that a specific Worker will be available, or that the Service will be uninterrupted or error-free.

    Accounts & eligibility

    • You must be at least 18 years old and legally entitled to work in or contract from the UK.
    • Account information must be accurate and kept up to date.
    • You are responsible for activity carried out under your account and for keeping credentials secure.
    • We may suspend or close accounts that breach these terms, present a safety risk, or fail verification checks.

    Fees & payment

    Clients are charged a flat fee of £15 per shift filled through the Service. Fees are exclusive of VAT where applicable and are invoiced on the terms shown at booking. Late payment may incur statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998.

    Workers are paid directly for the work they perform, typically within 7 days of the shift being completed and confirmed. Worker pay rates are agreed shift-by-shift between the Client and the Worker via the Service.

    Cancellations made less than 4 hours before a shift start time may still attract the £15 platform fee, as resourcing work will already have been carried out.

    Worker engagement

    Workers introduced via LYTWORK are engaged on a self-employed basis directly with the Client for the duration of the shift, unless a separate written arrangement is in place. Clients are responsible for on-site health and safety, supervision, and ensuring a safe working environment.

    LYTWORK carries out reasonable identity, Right to Work and (where applicable) DBS verification, but Clients remain responsible for their own compliance obligations as an end-user of labour.

    Acceptable use

    You agree not to:

    • Use the Service for any unlawful, fraudulent, or discriminatory purpose;
    • Attempt to bypass platform fees by transacting off-platform with Workers introduced via LYTWORK for a period of 6 months following introduction;
    • Scrape, reverse-engineer, or interfere with the Service or its underlying systems;
    • Misrepresent shift conditions, pay rates, or duties to Workers;
    • Harass, abuse, or discriminate against any other user of the Service.

    Liability

    Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

    Subject to that, our total liability arising out of or in connection with the Service in any 12-month period is limited to the greater of (a) the fees paid by you to LYTWORK in that period, or (b) £500. We are not liable for indirect or consequential loss, loss of profits, loss of business, or loss of goodwill.

    LYTWORK is not liable for the acts or omissions of any Worker or Client, nor for any loss arising from a Worker failing to attend or perform a shift.

    Termination & governing law

    Either party may terminate the agreement at any time with written notice. Termination does not affect any fees already accrued or any obligations that, by their nature, survive termination (including confidentiality, payment and liability provisions).

    These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with them.
